He Says: By signing up and actively using the He-SaysShe-Says.com program you agree to all terms and conditions set forth in this agreement. He-SaysShe-Says.com may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its members.
SheSays: Members will be informed of any and all changes to this policy via an email to their primary contact email address provided upon signing up with He-SaysShe-Says.com.
If any modification is unacceptable to you (I'll thump HeSays over the head with his editing software j/k), your only recourse is to terminate this agreement.
Your continued participation in the He-SaysShe-Says.com program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.

WeSay: Our PTC sections contain a Cheat Link. Do Not Click on this link. This Link is there to monitor "bot" traffic (automated software users) which is against our Terms of Service. 3 (Three) consecutive clicks on this banner, and your account WILL BE REMOVED WITHOUT FURTHER WARNING!

WeSay: Quality Control links (Cheat Links) are NOT refutable!. We properly announce these, when forced to send them, as well as, CLEARLY MARK the mails that contain these links.

WeSay: that He-SaysShe-Says reserves the right to change the text of any ad that begs, pleads or forces any action or threat to a member's account status!

WeSay: We will NOT advertise anything not allowed by Paypals Acceptable Use Policy. Paypal AUP

SheSays: also "no paid to join programs".....they have to be free programs. and "NO ADULT or PORN-TYPE of ADVERTISING ACCEPTED. No Multi-Level Marketing, Matrix, Pyramid Schemes or "GetRich!Quick" ads.
WeSay: No "no cash refund there is no guarantee on how long it will take to complete your signups."

Responsibility of Members:

He Says: You must be 17 years of age or older to participate in this program. Our program is open to both US and International Members and is void where prohibited by local governing laws.( Even though SheSays thinks I am still a minor at times, it's the child at heart thing you understand.)

SheSays: You agree to and must use your own name and email address in the sign-up process and may not assume a false identity.
You may not sign-up multiple times with different email addresses. (or HeSays will have a nervous breakdown)
Your computer must not be shared with another individual that has an existing He-SaysShe-Says.com account.(Specific exceptions should be direceted to the webmaster though.)

HeSays: You will use "your email address / password combination" to access your account, it is your responsibility to keep this information confidential, you may change this information by logging into your account and following the "Account Info." link.
SheSays: You are solely responsible for any and all use of your He-SaysShe-Says.com account including authorization by you to any third party individual who may use your account. (It's wise to keep this information to yourself and not share with anyone.)

HeSays: Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by He-SaysShe-Says.com be detected it may result in member termination and possible legal action.
(Well, if it is detected there won't be any maybe to it, unless you prove to SheSays why your account shouldn't be removed, otherwise you will lose your account.)
Any solicitation of advertisers for a confirmation email for purposes of receiving credit in your account will be grounds for immediate termination. Plain and simple!

SheSays: You must maintain your email account that you used when signing up He-SaysShe-Says.com. You agree to receive e-mail advertising from He-SaysShe-Says.com limited to no more than (500) per day.

HeSays: In the event your e-mail account on file becomes closed or blocked to messages from He-SaysShe-Says.com, for more than 7 consecutive days, your account will be terminated. If your account is inactive for 30 consecutive days your account will be removed.
SheSays: This especially applies to e-mail accounts returned for being Full.
Any member sending us gibberish will result in automatic termination of account and Forfeiture of All earnings to date of termination. Auto-responses will also be deleted immediately.( In otherwords speak to us as you would be spoken too.)

HeSays: You may NOT sell your account or any referrals to He-SaysShe-Says.com without express written consent from He-SaysShe-Says.com.

Relationship of the Parties:

HeSays: You and He-SaysShe-Says.com are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and He-SaysShe-Says.com.
(Simplified - We are the program owners, you are the clickers and readers or advertisers, no more no less.)
SheSays: You understand that you do not have authority to make or accept any offers or make any representations on behalf of He-SaysShe-Says.com.
You may not make any statement, whether on your site or otherwise, that would contradict anything in this section.
You are solely responsible for the reporting and payment of any taxes for money earned while using the program.

Limitation of Liability:

HeSays: He-SaysShe-Says.com will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or He-SaysShe-Says.com program, even if He-SaysShe-Says.com has been advised of the possibility of such damages.
(Limited liability unless we specify otherwise in writing to you.)
SheSays: Furthermore, He-SaysShe-Says.com aggregate (HeSays: "What in the world is aggregate? Hey, I need to go to law school now.")
liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement.
The provisions of this Section survive termination or expiration of the Agreement.

Payments:

He Says: Members may earn by receiving paid-emails and visiting the advertiser websites after they have entered their member ID in the area on the website provided by He-SaysShe-Says.com. Members may earn by referring new members to the He-SaysShe-Says.com program. Being 25% as active as their downline receives further credits to their accounts.
Members will earn a percentage of advertising revenues collected by He-SaysShe-Says.com.

SheSays: He-SaysShe-Says.com will pay members when "their" balance reaches the minimum payout rate set (according to membership type) by He-SaysShe-Says.com.

Referral bonuses are not considered your personal earnings, rather bonus earnings and do not apply to your cashout unless you have earned your personal earnings amount first.
Once the member has reached payout they may request payment. Payments will be made within 30 days or a reasonable time after.

Spam:

She Says: You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings,(DON'T SEND TO NEWSGROUPS UNLESS THEY KNOW YOU ARE SENDING FOR A PAID TO READ EMAIL SITE AND HAVE GIVEN YOU THEIR WRITTEN PERMISSION TO SEND SUCH!!!) or any other method of mass communication.
Failure to comply will result in immediate termination of your membership with He-SaysShe-Says.com and may result in legal prosecution.

He Says: He-SaysShe-Says.com strictly enforces anti-Spamming laws. Spamming is a federal crime.
Any member caught Spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident.
He-SaysShe-Says.com may charge up to $5 per spam email sent.
Multiple sign-ups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. He-SaysShe-Says.com will file charges for recovery of any earnings received from multiple sign-ups.
